NUTZUGSBEDINGUNGEN DER ORGAINVENT eLearning Academy
1 Geltungsbereich
Diese Nutzungsbedingungen beziehen sich auf die Nutzung der "ORGAINVENT eLearning Academy".
2 Das Online-Lernsystem
(1) Dieses eLearning-System ist ein Angebot der ORGAINVENT GmbH
(2) Die ORGAINVENT GmbH bietet auf der ORGAINVENT eLearning Academy Informationen, Wissensobjekte und Lernprogramme mit entsprechenden Zugriffsrechten an. Der Zugriff und die Nutzung der Unterlagen unterliegen den im Folgenden beschriebenen Nutzungsbedingungen. Zugriff und Nutzung werden Ihnen nur gewrt, wenn Sie diese Nutzungsbedingungen anerkennen.
3 Urheberrechte
Sie erkennen an, dass die auf der ORGAINVENT eLearning Academy enthaltenen Informationen, Texte, Software, Bilder, Videos, Grafiken, Sound und andere Materialien durch Urheber-, Marken- oder Patentrechte geschzt sind und dass die Urheber- und Verwertungsrechte ausschlieich der ORGAINVENT GmbH gehen.
4 Verwendung der Informationen und Materialien
(1) Das Ihnen auf der ORGAINVENT eLearning Academy gewrte Zugriffs- und Nutzungsrecht ist nicht ertragbar und steht nur Ihnen selbst zu. Sie sind berechtigt, die Materialien, die Ihnen auf der ORGAINVENT eLearning Academy zugglich sind, in dem angebotenen Umfang zu nutzen (z. B. zu lesen). Dieses Recht besteht ausschlieich f Ihren perslichen und nicht-kommerziellen Gebrauch.
(2) Sie verpflichten sich, die Materialien nicht f andere Zwecke zu vervielftigen, zu nutzen, zu verkaufen, zu ertragen, zu publizieren oder anderweitig zur Verfung zu stellen. Die Materialien dfen Sie auch nicht in Postings an Newsgruppen, Mailinglisten, elektronischen schwarzen Brettern u. verwenden, es sei denn, dass sich im Einzelfall eine entsprechende Erlaubnis entweder aus den Materialien oder aus dem Online-Lernsystem ergibt.
(3) Wenn Sie Materialien f andere Zwecke als hier aufgefrt verwenden wollen, wenden Sie sich bitte an die ORGAINVENT GmbH.
5 Standort und derung dieser Nutzungsbedingungen
(1) Der Wortlaut dieser Bedingungen kann online eingesehen werden unter dem Punkt "Nutzungsbedingungen" auf den Einstiegsseiten des Systems.
(2) Die ORGAINVENT GmbH ist berechtigt, jeden Abschnitt dieser Bedingungen zu jeder Zeit zu dern. derungen treten in Kraft, sobald die ORGAINVENT GmbH sie online publiziert hat. Durch Ihren fortgesetzten Gebrauch des Angebots stimmen Sie den gederten Nutzungsbedingungen zu und sind durch die Bestimmungen der gederten Bedingungen gebunden. Sie knen Ihre Zustimmung zu den derungen nur dadurch verweigern, dass Sie Ihre Subskription (Zugriff mit Ihren Registrierungsdaten) auf der ORGAINVENT eLearning Academy beenden.
6 derung des Angebots
Die ORGAINVENT GmbH kann Teile oder bestimmte Funktionen des Angebots jederzeit dern oder aur Kraft setzen. Entsprechend kann die ORGAINVENT GmbH jederzeit die Nutzung und den Zugang zu den Angeboten in der ORGAINVENT eLearning Academy sowie die Dauer und den Umfang der Nutzung beschrken. Die ORGAINVENT GmbH ist jedoch bestrebt, Ausfallzeiten mlichst kurz zu halten und daf Sorge zu tragen, dass alle Funktionen jederzeit zur Verfung stehen.
7 Registrierung (Anmeldung) und Zugangskennung
(1) Durch Nutzung der ORGAINVENT eLearning Academy unter diesen Bedingungen versichern Sie, dass
Sie Ihre Kennung und Ihr Passwort niemandem mitteilen werden,
Ihre Registrierungsdaten richtig und vollstdig sind,
Sie bei derung Ihrer Registrierungsdaten diese unverzlich korrigieren werden.
(2) Sie erkennen an, dass
Sie f jede Nutzung des Angebots auf der ORGAINVENT eLearning Academy verantwortlich sind, die mit Hilfe Ihrer Kennung und Ihres Passworts ausgefrt wird,
Sie daf Sorge zu tragen haben, dass Ihre Kennung und Ihr Passwort vor unautorisiertem Gebrauch geschzt sind,
Sie verpflichtet sind, die ORGAINVENT GmbH unverzlich zu benachrichtigen, falls Sie eine missbrchliche Verwendung Ihrer Zugangsdaten bemerken oder vermuten.
8 Ende der Nutzungsberechtigung des Online-Lernsystems
Die ORGAINVENT GmbH kann den Zugang zu den Inhalten der ORGAINVENT eLearning Academy in Teilen oder gzlich aussetzen oder Ihre Nutzungsberechtigung (Zugriff mit Zugangskennung und Passwort) beenden, wenn die Inhalte der ORGAINVENT eLearning Academy unter Ihrer Kennung und Ihrem Passwort, sei es durch Sie oder durch einen Dritten, in einer Weise genutzt werden, die aus Sicht der ORGAINVENT GmbH eine Verletzung dieser Bedingungen darstellt oder die in anderer Weise zu einem Nachteil f die ORGAINVENT GmbH fren kann.
9 Gewrleistung und Produkthaftung
(1) Die Inhalte der ORGAINVENT eLearning Academy werden auf der Basis "as-is" und "as-available" angeboten. Es gibt keine Gewrleistung.
(2) Sie stimmen ausdrklich zu, dass der Gebrauch der ORGAINVENT eLearning Academy sowie der Inhalte der ORGAINVENT eLearning Academy auf eigenes Risiko erfolgt. Die ORGAINVENT GmbH ernimmt keine Gewr, dass die Programmfunktionen den Anforderungen der Nutzer/innen genen oder in der von ihnen getroffenen Auswahl zusammenarbeiten. Weder die Anbieterin noch die Hersteller oder Entwickler haften f Schen, die aufgrund der Benutzung der ORGAINVENT eLearning Academy oder deren Inhalte entstehen.
Die Nutzung der ORGAINVENT eLearning Academy ist freiwillig.
Auf der ORGAINVENT eLearning Academy werden ab der Registrierung als Nutzer bzw. Nutzerin von Ihnen eingegebene oder mit Ihrer Nutzung automatisch anfallende Daten verarbeitet. Soweit diese auf Ihre Person verweisen, handelt es sich um personenbezogene Daten. Darum gelten auch f die ORGAINVENT eLearning Academy die einschligen datenschutzrechtlichen Regelungen.
Diese verlangen vor allem die eingehende Information er Art und Umfang der Erhebung von personenbezogenen Daten und Art und Weise ihrer weiteren Verarbeitung.
er die in der Anmeldung angegebenen, teils automatisch anfallenden, teils vom Nutzer bzw. der Nutzerin zuszlich eingegebenen Informationen hinaus protokolliert die der ORGAINVENT eLearning Academy zugrunde liegende Software ILIAS folgende Daten: Bearbeitungszeiten, Antworteingaben sowie Testergebnisse der Trainings- und Prungsteile Einschzungshilfe bzw. Abschlusstest. Hierdurch erhalten die Nutzer und Nutzerinnen die Mlichkeit, jederzeit einen Ausdruck ihres Teilnahmezertifikats erstellen zu knen. Darer hinaus werden keine nutzerspezifischen Daten erfasst. Insbesondere wird nicht erfasst, zu welcher Zeit welche Nutzer und Nutzerinnen auf welche Bestandteile der weiteren Lehrangebote bzw. Profile anderer Nutzer und Nutzerinnen zugreifen.
All diese Daten sind ausschlieich der Administration und dem explizit beauftragten Personenkreis der ORGAINVENT GmbH f administrative Zwecke zugglich, nicht jedoch anderen Nutzern oder Nutzerinnen. Sie dienen der Durchfrung der Weiterbildungsmaahme und werden nicht an andere Personen oder Stellen weitergegeben, auch nicht in anonymisierter Form. Die erhobenen personenbezogenen Daten werden nach den Grundszen der EU-Datenschutzgrundverordnung verarbeitet. Diese sind:

Mit der Registrierung und Nutzung der ORGAINVENT eLearning Academy geben Sie in Kenntnis dieser Erlterungen Ihre Einwilligung zu der bezeichneten Datenerhebung und -verwendung. Diese Einwilligung ist jederzeit frei widerruflich durch entsprechende Erklung gegener der Administration der ORGAINVENT eLearning Academy.

These Terms of Use apply to the use of the ORGAINVENT eLearning Academy.
2 The online learning system
(1) This eLearning system is an offer from ORGAINVENT GmbH
(2) ORGAINVENT GmbH offers information, knowledge objects and learning programs with corresponding access rights on the ORGAINVENT eLearning Academy. Access to and use of the documents are subject to the terms of use described below. You will only be granted access and use if you accept these terms of use.
3 Copyrights
You acknowledge that the information, texts, software, images, videos, graphics, sound and other materials contained on the ORGAINVENT eLearning Academy are protected by copyright, trademark or patent rights and that the copyrights and exploitation rights belong exclusively to ORGAINVENT GmbH.
4 Use of information and materials
(1) The right of access and use granted to you on the ORGAINVENT eLearning Academy is non-transferable and is available only to you. You are entitled to use (e.g. read) the materials accessible to you on the ORGAINVENT eLearning Academy to the extent offered. This right exists exclusively for your personal and non-commercial use.
(2) You undertake not to reproduce, use, sell, transfer, publish or otherwise make available the materials for other purposes. You may also not use the materials in postings to newsgroups, mailing lists, electronic bulletin boards, etc., unless permission is granted in individual cases either from the materials or from the online learning system.
(3) If you wish to use materials for purposes other than those listed here, please contact ORGAINVENT GmbH.
5 Location and amendment of these Terms of Use
(1) The wording of these terms and conditions can be viewed online under Terms of use on the initial pages of the system.
(2) ORGAINVENT GmbH is entitled to amend any section of these terms and conditions at any time. Amendments shall come into force as soon as ORGAINVENT GmbH has published them online. By continuing to use the offer, you agree to the amended terms of use and are bound by the provisions of the amended terms. You can only refuse your consent to the changes by terminating your subscription (access with your registration data) to the ORGAINVENT eLearning Academy.
6 Modification of the offer
ORGAINVENT GmbH may change or suspend parts or certain functions of the offer at any time. Accordingly, ORGAINVENT GmbH may at any time restrict the use of and access to the offerings in the ORGAINVENT eLearning Academy, as well as the duration and scope of use. However, ORGAINVENT GmbH endeavors to keep downtimes as short as possible and to ensure that all functions are available at all times.
7 Registration (login) and access code
(1) By using the ORGAINVENT eLearning Academy under these terms and conditions, you warrant that
You will not disclose your ID and password to anyone,
your registration data is correct and complete,
you will correct any changes to your registration data without delay.
(2) You acknowledge that
* you are responsible for any use of the ORGAINVENT eLearning Academy service that is carried out with the help of your ID and password,
* you must ensure that your ID and password are protected against unauthorized use,
* you are obliged to inform ORGAINVENT GmbH immediately if you notice or suspect any misuse of your access data.
8 End of authorization to use the online learning system
ORGAINVENT GmbH may suspend access to the contents of the ORGAINVENT eLearning Academy in part or in full or terminate your authorization to use the system (access with access ID and password) if the contents of the ORGAINVENT eLearning Academy are used under your ID and password, whether by you or by a third party, in a manner which ORGAINVENT GmbH considers to be a breach of these terms and conditions or which may otherwise be detrimental to ORGAINVENT GmbH.
9 Warranty and product liability
(1) The contents of the ORGAINVENT eLearning Academy are offered on an as-is and as-available basis. There is no warranty.
(2) You expressly agree that the use of the ORGAINVENT eLearning Academy and the contents of the ORGAINVENT eLearning Academy is at your own risk. ORGAINVENT GmbH does not guarantee that the program functions will meet the user's requirements or that they will work together as selected by the user. Neither the provider nor the manufacturers or developers shall be liable for any damages arising from the use of the ORGAINVENT eLearning Academy or its contents.
Use of the ORGAINVENT eLearning Academy is voluntary.
From the time you register as a user on the ORGAINVENT eLearning Academy, data entered by you or automatically generated by your use will be processed. Insofar as this data refers to your person, it is personal data. The relevant data protection regulations therefore also apply to the ORGAINVENT eLearning Academy.
Above all, these require detailed information about the type and scope of the collection of personal data and the way in which it is further processed.
In addition to the information provided during registration, some of which is collected automatically and some of which is additionally entered by the user, the ILIAS software on which the ORGAINVENT eLearning Academy is based logs the following data: Processing times, answer entries and test results of the training and examination sections Assessment aid and Final test respectively. This enables users to generate a printout of their certificate of participation at any time. Beyond this, no user-specific data is recorded. In particular, it is not recorded at what time which users access which components of the other courses or profiles of other users.
All this data is only accessible to the administration and the explicitly authorized group of people at ORGAINVENT GmbH for administrative purposes, but not to other users. They are used to carry out the training measure and are not passed on to other persons or bodies, not even in anonymized form. The personal data collected is processed in accordance with the principles of the EU General Data Protection Regulation. These are:

* accuracy
* Storage limitation
* Integrity and confidentiality
* Accountability

In principle, we grant you as the data subject the following rights:

Consent
By registering and using the ORGAINVENT eLearning Academy, you give your consent to the collection and use of data as described in these explanations. This consent is freely revocable at any time by means of a corresponding declaration to the administration of the ORGAINVENT eLearning Academy.
